All licensing agreements are subject to a 3% tax on gross receipts, due by March 15. Existing contracts are not affected.

Contract and Conduct Requirements

At least 72 hours before executing a contract, a PRO must provide written notice of rate schedules, and upon request, current member and copyright work lists, along with a toll-free inquiry number.

PROs must identify themselves before entering premises to discuss contracts and may only collect royalties under a valid agreement. They may inform proprietors of federal copyright obligations.

Remedies for Violations

Violations allow proprietors to seek damages, injunctions, attorney fees, and other remedies. The act complements other laws and does not apply to FCC-licensed broadcasters, cable operators, or specific criminal investigations under Kansas law.
