This statute defines a PRO’s licensing area as a 25-mile radius around the proprietor's business. At least 72 hours before executing a contract, the PRO must provide written notice including:

  • the rate schedule

  • rates for similar local businesses

  • a toll-free number

  • any discount terms

  • a notice of the proprietor's right to this information—failure to provide it renders the contract unenforceable

PROs must maintain a toll-free number for inquiries about members and works.

Contract and Conduct Requirements

Contracts must be in writing, signed by both parties, and include the proprietor’s details, the PRO’s name/address, contract duration, and rate schedule. PROs must offer a 1-year contract but may offer longer terms.

PRO agents must disclose their identity, the PRO they represent, and their purpose before discussing or collecting fees. PROs may only collect fees stated in the contract and may not use unfair tactics or charge unreasonable rates compared to similar local licenses.

This law applies only to PROs and does not cover copyright holders of video, contracts with FCC-licensed broadcasters, cable operators/programmers, or certain criminal law enforcement actions.

Remedies for Violations

Violations allow proprietors to seek actual damages, attorney fees, injunctions, and other legal relief. The statute complements existing federal, state, and common law.
