Before entering a business to discuss a contract, a PRO must identify themselves and their purpose.

Contract and Conduct Requirements

At least 72 hours prior to executing a contract, the PRO must provide written notice of:

• rate schedule and terms

• access to the current member/affiliate list if requested

• notice that the full list of copyrighted works can be requested in writing at the proprietor's expense

• confirmation of compliance with laws and court orders regarding licensing terms

Contracts must be in writing, signed by both parties, and include detailed identifying information. PROs cannot collect royalties without a valid contract. They may investigate music use and inform proprietors of legal obligations.

Remedies for Violations

Violations allow the proprietor to seek damages, legal fees, injunctions, or other remedies. This chapter works in conjunction with other laws and does not apply to FCC-licensed broadcasters, cable operators, or music synchronized with audio/visual works.
