A deeper understanding on why PROs approach presenters

Understanding the PROs

Who are the main PROs?

There are a multitude of PROs around the globe, but the main PROs relevant in the United States are…

  • ASCAP - American Society of Composers, Authors, and Publishers

  • BMI - Broadcast Music, Inc

  • SESAC - Society of European Stage Authors and Composers*

  • GMR - Global Music Rights*

  • AllTrack & Pro Music Rights (two separate PROs that are smaller and are newer to the market)

*GMR and SESAC are invitation-only groups.

Why do the PROs approach me?

PROs approach presenters (venue owners, festival execs, and concert promoters) to ensure venue owners are compliant with copyright law and have the proper licenses to cover their music usage.

Am I allowed to negotiate contract terms?

Yes, you are able to negotiate contract terms with each individual PRO. Depending on the state, there are some baseline terms required by state law that each PRO must present. There are also specific laws dictating the manner in which PROs approach business owners. Check out our PRO state statute summaries here for specific information by state.

Should I respond to them?

Yes. It is very important to respond to them. Opening up the conversation for contract negotiations puts you in a better position rather than ignoring them.

How do I know they are legitimate?

You can tell that PROs are legitimate by looking up their catalogue on their website. Most PROs have a search engine where you can look up their artists and the music they represent. View AllTrack (a U.S. based PRO company) and their catalogue search engine here as an example.

Remember…

PROs do NOT want to put you out of business. Their main objective is to represent the artists in their registry, and without venues to perform, their artists don’t earn royalties.
