Contract and Conduct Requirements

Under Alaska law (AS 45.45.500–590), performing rights organizations (PROs) must provide notice at or within 72 hours before offering a licensing contract. This notice must include:

  • royalty rates and terms (including discounts and rate changes)

  • a toll-free number for inquiries

  • and a notice that a list of represented works is available via the Cabaret Hotel and Restaurant Retail Association

Licensing contracts must include:

  • Business and venue details

  • Contract duration (not to exceed one year unless part of a national contract)

  • Royalty terms and rate schedules

  • Automatic renewal provisions unless terminated with 30 days’ notice

PROs may not collect royalties or enter premises without full disclosure if the contract doesn’t comply with these standards.

Remedies for Violations

Violations allow injured parties to seek damages and legal relief.

Exemptions

Exemptions include contracts with FCC-licensed broadcasters, cable operators, law enforcement investigations, and agreements involving software publishers. These laws do not limit PROs' copyright enforcement rights or ability to inform proprietors of legal obligations.
