PROs must annually file with the state department for public inspection:
Certified copies of all current documents used by the PRO,
The most up-to-date list of members and works represented.
PROs are required to:
Provide information about specific works upon request by the proprietor via phone or electronic means
Provide the filed documents upon request, at the proprietor’s expense
Pre-Contract Requirements
At least 72 hours before executing a contract, the PRO must provide written notice:
Outlining its legal duties under the statute
Confirming compliance with applicable federal or court orders regarding royalty rates, terms, and contract conditions
PROs are prohibited from making incomplete or false disclosures in this notice
Contract Requirements
All contracts must be:
In writing and signed by both parties,
Include the proprietor’s name, business address, applicable locations, PRO name, contract duration, and royalty rate schedule.
Conduct Restrictions
PRO agents must identify themselves and state their purpose before entering a proprietor’s business to discuss licensing.
Remedies
Proprietors may seek actual damages, attorney fees, court costs, and other legal or equitable relief for violations. This section does not limit any other legal rights or remedies.
