PROs are required to:

• Maintain a regularly updated electronic list of their members and affiliates (updated quarterly),

• Provide the state with access to the list's electronic address,

• Allow public viewing of the list through the state upon request,

• Provide paper or electronic copies of the list upon request at cost (excluding overhead/maintenance),

• Maintain a toll-free number for inquiries about specific works or members.

At least 72 hours before executing a contract, PROs must provide in writing:

• The rate schedule, including any discounts, sliding scales, or scheduled changes during the contract term.

Contract Requirements

For contracts entered into or renewed after July 1, 1998, the contract must:

• Be in writing

• Be signed by both partie

• Include the proprietor’s name, business address, and covered location; the PRO’s name and address; contract duration; and the full rate schedule.

Remedies for Violations

Violations allow for recovery of actual damages. These remedies are not exclusive and may be combined with other legal rights, causes of action, or penalties.

This section does not apply to:

• Licensing contracts with FCC-licensed broadcasters (unless the PRO is the licensing party)

• Law enforcement or others investigating violations of subsection 13-10-8(2)(b)
