There is a 3% tax on licensing agreements due annually by March 15. PROs must register with the Department of Revenue before February 15 each year and file every contract variation. Failure to register or renew on time results in a $10,000 fine for every 45-day period of noncompliance. PROs must also make their current list of works and members available electronically.

Contract and Conduct Requirements

At least 72 hours before offering or executing a contract, PROs must provide in writing the rate schedule and notice of the proprietor's right to access PRO information filed with the Department of Revenue.

PRO agents must identify themselves, their affiliation, and their purpose before discussing contracts or collecting royalties. They are prohibited from:

  • Using obscene or offensive language

  • Calling outside business hours without consent

  • Engaging in coercive or disruptive behavior

  • Using unfair or deceptive negotiation tactics

  • Contacting a proprietor who has requested all communications go through their attorney (unless the attorney is unresponsive for 60 days)

The Department of Revenue must inform proprietors of their rights and responsibilities as part of business licensing services. PROs may investigate music use and inform proprietors of their legal obligations. They must also avoid discriminatory pricing, though reasonable adjustments for business or market conditions are allowed.

Remedies for Violations

Violations of this act carry fines: a minimum of $500 for the first offense and up to $2,000 for subsequent offenses.
